Caterpillar (NYSE: CAT ) rose 0.88% after the release of the strong homebuilder confidence and industrial production numbers, the latter of which takes into account not only output from U.S. factories but also from mines and utility companies. And since Caterpillar is a big player in the mining equipment field, investors surely saw this report as good news for the company.

Among Dow stocks moving higher today was�Caterpillar� (NYSE: CAT ) , which jumped 2.8% today as it defends its tax-avoidance practices in front of Congress this week. The heavy-equipment maker responded to allegations from a Senate subcommittee that said it has avoided $2.4 billion in taxes over the last 13 years by moving profits to a Swiss affiliate without transferring employees or business activities. Executives defended the practices, saying that "business practices drives our tax structure," not the other way around. Sen. Rand Paul (R-Ky.) took the opposite tack from Democrats in grilling the multinational manufacturer, going as far to salute Caterpillar for its strategy and success as an iconic American business. "We should probably give Caterpillar an award," he said. "It is a requirement that you try to minimize your costs. So rather than chastising Caterpillar we should be complimenting them." Caterpillar is just one of many blue chips that's been hauled before Congress to defend its tax strategy. Investors seemed to like the results of the hearing based on the stock's gains.�

Blue Sphere has other major partners on these projects as well.� They have brought in a hedge fund that specializes in Cleantech investing as an equity partner.� This equity partner has committed to up to $7.5 million for the Charlotte project and $5 million for the smaller Johnson plant.� Caterpillar Financial Services, a division of Caterpillar Inc. (NYSE: CAT) is providing almost $18 million in debt for the construction of the Charlotte project.� Both groups are expected to fund upon their respective commitments to the Charlotte project by the end of August, which will allow Blue Sphere and Biogas Nord to begin construction of the facility in September of this year.� Blue Sphere�� management has stated that they expect the Charlotte project to be complete and producing with in 12 months of the beginning of construction.�

Is Caterpillar (CAT) really in the Dow? The beaten down industrial stock has gained 3.1% to $89.95 today, more than one percentage point more than Alcoa (AA), the next biggest winner with a 1.9% gain. The Travelers Companies (TRV) has gained 1.9% to $81.99, and 3M (MMM) has climbed 1.5% to $116.78. The Dow Jones Industrial Average has risen 0.9%.
To put Caterpillar’s gain in perspective, its the stock’s largest jump since May 3, when it rose 3.2%. And with time still remaining today, it could advance even higher.
We’ll chalk the big move up to the better economic news out of China last night, as well as sentiment that the global economy is picking up steam. The Caterpillar is also an industrial stock, and those are pretty popular right now.
I wouldn’t make too much of the move just yet, however. For starters, Caterpillar has been stuck in a range since March, as the following chart shows:
And, as Morgan Stanley reminded investors last week, the market might be expecting too much from Caterpillar. On Sept 5, analyst�Nicole DeBlase and team wrote:

We are more bearish on Mining CapEx as we do not expect the second derivative of cuts to turn positive until 2016e.

The largest detractor for the quarter was CNH Industrial (CNHI), a global agricultural and construction equipment manufacturer, which fell 11%.� CNH released its nine-month results, which showed revenue growth of 0.6%, but the company�� margins were adversely affected by Iveco, its trucks and commercial vehicles segment.� Iveco�� margins fell short of expectations due to tough pricing, high launch costs, negative mix and increases in bad debt provisions.� Management maintains full-year guidance of 3-4% revenue growth.� We believe improvements in the Iveco division will help CNH Industrial achieve its long-term margin targets.�
